By downloading, installing, or using the Watch Collectors Club mobile application ("App") or visiting this website ("Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the App or Site.
Description of Service
Watch Collectors Club provides:
- Watch valuation estimates based on live eBay market data.
- A community photo gallery powered by the Watch Collectors Club Flickr group.
- Personal collection tracking stored locally on your device.
- Watch trivia and educational content about watchmaking brands and history.
- A global photo map showing where community watch photos were taken.
Valuations Are Estimates Only
All watch price valuations provided by the App are estimates derived from publicly available eBay sold listing data. They are provided for informational purposes only and do not constitute a professional appraisal, insurance valuation, or guaranteed sale price.
- Market prices fluctuate continuously. A valuation shown today may not reflect tomorrow's market.
- The App does not account for factors such as provenance, service history, undisclosed damage, or local market conditions.
- Watch Collectors Club is not a licensed appraiser and accepts no liability for decisions made based on App valuations.
- For insurance, estate, or sale purposes, please consult a certified watch appraiser.
Community Gallery and User Content
The community gallery is powered by the Watch Collectors Club pool on Flickr. By uploading photos:
- You confirm you own the rights to, or have permission to share, any photo you upload.
- You grant the Watch Collectors Club community a non-exclusive licence to display your photo within the gallery.
- You must not upload content that is unlawful, offensive, defamatory, or infringes on third-party rights.
- Photos of watches are welcome; unrelated or inappropriate content will be removed.
- Community photos remain subject to Flickr's Terms of Service.
We reserve the right to remove any content from the gallery at our discretion.
Intellectual Property
The Watch Collectors Club name, logo, app design, and original website content are our property. You may not reproduce, distribute, or create derivative works without written permission.
Watch brand names (Rolex, Patek Philippe, Audemars Piguet, etc.) are trademarks of their respective owners. Watch Collectors Club is not affiliated with or endorsed by any watch manufacturer.
eBay is a trademark of eBay Inc. Flickr is a trademark of SmugMug Inc. Watch Collectors Club is not affiliated with either company.
Prohibited Uses
You agree not to:
- Use the App or Site for any unlawful purpose.
- Attempt to reverse-engineer or decompile the App.
- Scrape or harvest data from the App or Site in an automated manner.
- Upload malware, spam, or harmful content to the community gallery.
- Use valuation data to misrepresent watch values in commercial transactions.
- Impersonate Watch Collectors Club or any member of the community.
Disclaimer of Warranties
The App and Site are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that valuation data is accurate, complete, or current.
Limitation of Liability
To the fullest extent permitted by law, Watch Collectors Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Site, including financial decisions made based on watch valuations.
Third-Party Services
The App integrates with eBay and Flickr APIs. Use of these services is subject to their respective Terms of Service. Watch Collectors Club is not responsible for the availability, accuracy, or conduct of these third-party services.
App Store Terms
Your use of the iOS version is also subject to Apple's App Store Terms of Service. The Android version is subject to Google Play's Terms of Service.
Changes to These Terms
We may update these Terms at any time. The "Last updated" date at the top reflects changes. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of the United States.
